Contracts between families and agencies

These contracts are made in cases in which the clients (families) contact an agency so that it assists them in the search for a nanny that meets their needs. 

They usually contain the following agreements: 

  • The agency may provide some applicants’ documents check such as criminal record checks, driving record checks, child abuse check, and reference verification.
  • All contact between families and applicants should be reported to the agency, they can even ask to be intermediaries in the first contacts.
  • The agency should be the first to know if the family wants to hire one of the applicants and the family should obtain authorization from the agency before sending an offer to the nanny.
  • The agency will know in advance when the nanny will start working.
  • The family may report the nanny's performance to the Agency.
  • Fees related to the services offered and nanny’s payments. 
  • Replacement nannies (if needed).
  • Confidentiality.
  • Length of contracts.
  • Refunds.
  • Calls for follow-up.

Contracts between nannies and agencies

Apart from the contract that must exist between the families and the nannies, it is common that they must also sign one with the agency that acts as an intermediary (if applicable). This case occurs when a nanny contacts an agency to help her find a family.

In this type of contract, the following agreements are usually presented:

  • The agency can ask the nanny for personal documentation to do a background check, this documentation may include a driving record, criminal record, references, and an identification document.
  • Confidentiality agreement between the agency and the families during and for a certain time after the contract ends.
  • Payment agreement whether the payment is received from the agency or directly from the family.
  • Keep the agency aware of communications between you and the family.
  • Permission to accept any job offer from a family associated with the agency.
  • Agreement to maintain contact while the nanny is working with the family.
  • Some agencies may add a release from the responsibility of damages you may have during your time working with the family.
